Case Background And Summary
In 2008, class actions were commenced in Ontario and Québec against TVI and certain of its current and former officers and directors (the "Defendants"). The lawsuits allege that TVI Pacific Inc. and certain defendants provided investors with false and misleading information that artificially inflated the value of TVI Pacific Inc. securities during the period from March 30, 2006, to August 9, 2007. The TVI Pacific Settlement Fund was created as a result of the settlement reached between the Parties to the Litigation on April 22, 2009.
Under the proposed settlement the Defendants have paid $2,100,000 to settle the lawsuit. The following Court certified class of people are eligible to receive payment from the TVI Pacific Settlement Fund:
ALL PERSONS, AND ENTITIES (OTHER THAN EXCLUDED PERSONS, AS DEFINED IN THE SETTLEMENT AGREEMENT), WHO ACQUIRED SECURITIES OF TVI PACIFIC INC. ("TVI") DURING THE PERIOD FROM AND INCLUDING MARCH 30, 2006, TO AND INCLUDING AUGUST 9, 2007 ("CLASS PERIOD"), AND HELD SOME OR ALL OF THOSE SECURITIES ON AUGUST 9, 2007 ("CLASS MEMBERS").
The settlement monies, after payment of Court-approved Class Counsel Fees and Administrative Expenses (the "Net Settlement Fund"), will be divided among all Class Members who send in valid Proof of claim form and releases and have sustained a net loss in their Class Period transactions in TVI securities ("Authorized Claimants").
To be eligible for participation in this distribution, you must either electronically submit your proof of claim and release online at www.tvipacificsettlement.com no later than January 18, 2010 OR download a copy of the Proof of Claim form and Release at www.tvipacificsettlement.com, complete, sign and mail it to the Claims Administrator no later than January 18, 2010 (postmark date).
